Welcome to Majek Rehabilitation, PLLC (“Majek Rehabilitation, PLLC,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website (majekrehab.com), communications (including A2P/10DLC text messaging), and professional services. By accessing or using our website or services, you agree to these Terms.

1) Acceptance of Terms

By using our site or services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree, do not use our site or services.

2) Eligibility & Appropriate Use

You must use our services only for lawful purposes. You represent you have authority to engage us (for yourself or on behalf of a patient where permitted) and that information you provide is accurate and complete.

3) Description of Services

We provide physical, occupational, and speech therapy services, and coordinate with therapists and home health agencies serving Northern Virginia and surrounding areas. Site content and communications are informational and administrative; they do not replace professional medical advice.

4) A2P/10DLC Text Messaging (SMS/MMS)

  • Opt-In: You will receive texts only if you opt in (e.g., by providing your number via our website or replying to a keyword). Typical frequency is up to 4 msgs/month; frequency may vary by interaction.
  • Fees: Message and data rates may apply.
  • Opt-Out: Reply STOP to any message to unsubscribe. We will send one confirmation text and then cease messaging unless you opt in again.

  • Consent Not a Condition: Consent to receive texts is not a condition of treatment, employment, or purchase.

  • Carrier Disclaimers: Delivery is subject to your carrier’s network; carriers are not liable for delayed or undelivered messages.

5) Scheduling, Payments & Insurance

Scheduling, rates, coverage, and billing practices may vary and will be confirmed during intake or by agreement. Any estimates are informational and not guarantees of coverage or outcomes. You are responsible for charges not covered by insurance, if applicable.

6) No Medical Advice; Emergencies

Information provided on our site or via SMS/email is not medical advice and is not a substitute for professional evaluation. In an emergency, call 911 or your local emergency number immediately.

7) HIPAA & PHI

When we act as a covered entity or business associate under HIPAA, we handle protected health information (PHI) in accordance with HIPAA and applicable law. This Terms page is distinct from any HIPAA Notice of Privacy Practices.

8) Intellectual Property

All content on the site—text, graphics, logos, and design—is owned by or licensed to Majek Rehabilitation, PLLC and protected by law. You may not reproduce, distribute, or create derivative works without prior written permission.

9) Prohibited Conduct

  • Misuse of our services, including attempting to disrupt or compromise security.
  • Submitting false, misleading, or unlawful information.
  • Violating third‑party rights or applicable laws and regulations.

10) Disclaimers

OUR SITE, COMMUNICATIONS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION.

11) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAJEK REHABILITATION, PLLC, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, DATA, OR GOODWILL; ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, COMMUNICATIONS, OR SERVICES. OUR MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12) Indemnification

You agree to defend, indemnify, and hold harmless Majek Rehabilitation, PLLC and its affiliates, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of our services, or infringement of third‑party rights.

13) Dispute Resolution; Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict‑of‑laws rules. Any dispute shall be resolved by binding arbitration in Washington, D.C., under the rules of the American Arbitration Association. YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

14) Changes to the Terms

We may update these Terms from time to time. We will post the revised Terms with the effective date above. Your continued use of the site or services after changes are posted constitutes acceptance.

15) Miscellaneous

  • Severability: If any provision is held invalid, the remaining provisions remain in full force.
  • No Waiver: Failure to enforce a provision is not a waiver of that provision.
  • Entire Agreement: These Terms, plus any service‑specific agreements and our Privacy Policy, constitute the entire agreement between you and us regarding the site and communications.
